FOLLOW WIZ — TERMS OF SERVICE

Follow Wiz is a software-as-a-service platform designed to help businesses manage customer communications, appointments, reminders, follow-ups, AI-powered conversations, and related workflows.

Features may include AI-powered SMS messaging, AI voice calls, an AI receptionist, appointment confirmations, customer follow-ups, scheduling and rescheduling assistance, customer management, notifications, and other automation tools.

Features may be added, changed, limited, or discontinued over time.

You must be at least 18 years old and legally capable of entering into a binding agreement to use Follow Wiz.

If you use Follow Wiz on behalf of a business or other organization, you represent that you have authority to accept these Terms on behalf of that organization.

You are responsible for maintaining the confidentiality and security of your account credentials.

You are responsible for all activity conducted through your account and for ensuring that the information you provide to Follow Wiz is accurate and current.

You must promptly notify us at support@followwiz.com if you believe your account has been accessed or used without authorization.

Follow Wiz may integrate with or rely upon third-party products and services, including telecommunications providers, artificial intelligence providers, hosting providers, payment processors, and other technology services.

For example, certain functionality may depend on services provided by Twilio and Google Gemini.

Your use of third-party services may also be governed by the terms, policies, pricing, limitations, and requirements of those providers.

Follow Wiz is not responsible for outages, errors, account suspensions, pricing changes, service limitations, or other issues caused by third-party providers.

Follow Wiz uses artificial intelligence to automate certain communications and actions.

AI-generated responses may occasionally be inaccurate, incomplete, inappropriate, or unexpected. You are responsible for configuring, reviewing, testing, and monitoring your AI Agents and the information provided to them.

You should not rely on Follow Wiz or its AI features for medical, legal, financial, emergency, or other professional advice.

You remain responsible for how Follow Wiz is configured and used within your business.

If you use Follow Wiz to send SMS messages, make calls, use automated or AI-generated communications, record calls, or otherwise contact customers, you are responsible for ensuring that you have all permissions and consents required by applicable law.

You are also responsible for complying with applicable telecommunications, privacy, consumer protection, marketing, call-recording, and messaging laws and regulations.

This may include requirements relating to the Telephone Consumer Protection Act (TCPA), applicable state laws, carrier requirements, and messaging-industry requirements.

You must honor applicable opt-out requests and must not use Follow Wiz to send unlawful spam or contact individuals without legally required consent.

Follow Wiz provides tools to assist with communications and consent management, but these tools do not constitute legal advice and do not guarantee compliance.

You may provide Follow Wiz with information relating to your customers, including names, phone numbers, email addresses, appointment information, customer notes, conversation information, and other information necessary to use the Service.

You represent that you have the legal right to provide and process this information through Follow Wiz.

You remain responsible for the accuracy and legality of customer information you submit to the Service.

You may not use Follow Wiz to:

• Violate any applicable law or regulation; • Send spam or unlawful communications; • Harass, threaten, deceive, or impersonate another person; • Engage in fraud or other deceptive practices; • Distribute malware or malicious code; • Attempt to gain unauthorized access to Follow Wiz or another user's account; • Interfere with the security or operation of the Service; • Use customer information without appropriate authorization; • Circumvent usage limits or security measures; or • Use Follow Wiz for any unlawful, abusive, or harmful purpose.

We may suspend or terminate accounts that violate these requirements.

Certain Follow Wiz features require a paid subscription.

By purchasing a subscription, you authorize the applicable payment method to be charged according to the pricing and billing terms presented to you at checkout.

Unless otherwise stated at the time of purchase, subscriptions may automatically renew until canceled.

You are responsible for third-party usage charges associated with services you connect to Follow Wiz, including applicable telecommunications, AI API, or other third-party charges.

Canceling Follow Wiz does not necessarily cancel services or charges billed separately by third-party providers.

ALL SALES ARE FINAL.

Except where a refund is required by applicable law, Follow Wiz does not provide refunds, credits, or prorated refunds for purchases, subscription payments, renewals, unused subscription time, unused features, or partially used billing periods.

You are responsible for canceling your subscription before your next renewal date if you do not wish to be charged again.

Failure to use the Service does not entitle you to a refund.

Nothing in this section limits any refund or cancellation right that cannot legally be waived under applicable law.

You may cancel your Follow Wiz subscription according to the cancellation options available within your account.

Cancellation prevents future renewals but does not retroactively refund previous charges.

Unless otherwise stated, you may continue using paid features through the remainder of your current paid billing period after cancellation.

We work to keep Follow Wiz operational, but we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

Features may temporarily become unavailable because of maintenance, technical problems, third-party outages, telecommunications issues, AI provider issues, or circumstances outside our control.

Follow Wiz and its software, branding, interfaces, designs, logos, technology, and other proprietary materials are owned by Follow Wiz or its licensors and are protected by applicable intellectual property laws.

These Terms provide you with a limited, non-exclusive, non-transferable right to use the Service while your account remains authorized.

They do not transfer ownership of Follow Wiz intellectual property to you.

We may suspend, restrict, or terminate access to Follow Wiz if we reasonably determine that an account:

• Violates these Terms; • Creates security or legal risk; • Is involved in fraudulent or abusive activity; • Has unpaid amounts due; • Misuses third-party services connected to Follow Wiz; or • Could negatively affect Follow Wiz, our providers, customers, or other users.

You may stop using Follow Wiz at any time.

To the maximum extent permitted by law, Follow Wiz is provided on an "as is" and "as available" basis.

We do not guarantee that AI-generated responses will always be accurate, that communications will always be successfully delivered, that customers will respond, that appointments will be confirmed, or that use of Follow Wiz will produce any particular business result.

To the maximum extent permitted by applicable law, Follow Wiz and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, lost data, or damages resulting from customer communications.

To the maximum extent permitted by law, Follow Wiz's aggregate liability arising from the Service will not exceed the amount you paid directly to Follow Wiz during the twelve months preceding the event giving rise to the claim.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Follow Wiz and its owners, affiliates, employees, and contractors from claims, damages, liabilities, losses, and expenses arising from your misuse of the Service, violation of these Terms, violation of applicable law, or communications you initiate through the Service.

We may update these Terms periodically.

When material changes are made, we may provide notice through the Service or by other reasonable means. Your continued use of Follow Wiz after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
